(NORWALK, Calif.) - Edwina McCombs, a Tennessee resident, who was visiting Southern California to vacation with her 8 and 9-year old daughters, was awarded $85,000 today when a jury found Value Lodge, an Artesia motel, liable for involuntarily subjecting her girls to hardcore pornographic movies. Ms. McCombs checked into the Value Lodge where she informed the front desk that she was there with her two young daughters. When she was in the room, Ms. McCombs went to take a bath and the children turned on the television to watch a children’s show. Instead, the children were subjected to hardcore pornography with close-up images of people engaged in sodomy and homosexual acts. Leejanice Toback, an attorney for McCombs, stated that this is probably the first such verdict against a hotel or motel for showing pornography. “This shows that hotels cannot ignore the duty of care they owe their patrons. If hotels don’t have lock-outs that prevent young children from being involuntarily subjected to pornography, they will be liable,” said Eliot Krieger. The trial lasted two weeks. During the trial, the plaintiffs presented testimony from hotel expert Alan Snyder, who commented that in his thirty years experience, he has never seen a family hotel where some affirmative action was not necessary in order to access adult material. Although the motel claimed that there were signs warning the patrons that the adult channel could be turned off by the front desk, interviews with the jury indicated that no one believed it. The plaintiffs also called Dr. Michael Perrotti, who extensively tested the children and described the harm that exposure to pornographic images have on young children. Dr. Perrotti stated that a child’s mind is like a hard drive on a computer and the images once implanted, are difficult to remove. The girl’s parents and attorneys Leejanice Toback and Eliot F. Why is it mentioned that it was "Homosexual" porn. Does that make it worse? Would it have been more acceptable if it were straight porn? I suspect the prosecution played on southerners' prejudices by making it a gay thing -- like these girls are now ruined forever. Get over yourselves. Sex happens, people see it. Control your own children.

You two are a couple of real pieces of work. Nice job of stereotyping there guys. I guess (in your narrow minds) $85K is a jackpot to people from TN, and is it because they are from TN you think they are going to blow the money on a boat or RV for their kid's "trauma", and that people from TN stay in hotels that charge by the hour. You two probably don't even have kids. Curmudgeon, whose "stayed in a lot of motels", (not sure why…..) states that he/she has never seen unrestricted access to porn. (I guess he/she always had to pay for it.) That statement in itself should say to you that a person should have a reasonable expectation that they shouldn’t have to do like Neal (which I truly doubt he does) and “check what was on all channels and making sure the desk knew no porn was allowed in my room for the duration of my stay”? And what makes you think that these people stay at a lot of hotels like you do and even know that porn is available on the TV? You two make a lot of assumptions for knowing very little about these people and are great armchair quarterbacks. Commercial businesses that cater (and make their money) on families should have built-ins to protect kids and when they don't, they should pay for it.

The first thing Edwina McCombs should have done is discipline the children for tuning it in and watching it. I have stayed in a lot of motels, and I have never been in one that had unrestricted access to porn. I think all of them probably had it available, but you have to ask and then pay extra. Maybe she shouldn't have chosen a motel that charges by the hour.

I'll bet the parents are thrilled. They got a $85,000 jackpot. Is that cash going solely to treatment for their 'traumatized' kids or more likely will the family just get a boat and RV to 'help them get over the trauma'? What ever happened to personal and parental responsibility? I would never leave my kids with full access to a hotel tv without checking what was on all channels and making sure the desk knew no porn was allowed in my room for the duration of my stay if I was travelling with my kids. In my mind this ruling is ridiculous and sets an exceptionally bad precedent. Ah well...
