I have a strange feeling that Jose was on to a large police corruption in the area. So they had to justify some way of killing him. 71 shots 60 hits something wrong here. They wanted him dead.

Every cop you see what you to tell them what you did wrong and if you say i have a right to remain silent they do everything in there short power to lie and cheat and the proscutors go right along because they work for them. Dear Cop; No, lights weren't "on"; sirens weren't "blaring". Cops Claimed they "announced", "ran siren 8 seconmnds", but neither Mrs. Guerena nor any neighbor recall this. Plus, the "siren" could have been mistaken for a car alarm. One SWAT team member had the car radio on, listening to music! This could have helped drown-oout their "identification". Plus, it is their word against Guerena family--ythey lied about the warrant and the gun going off, changing their story. Why not Lie about Everything to cover their a****s? Cops Always do... No, SWAT team NOT authorized to "open fire" if someone is simply pointing a gun when they bust-in. They are specially trained to give him that warning, that 3 seconds. That's why they wear body armor--to safely wait the 3 seconds. Plus, the escalation of force. Only an untrained, beat patrolman would trigger on a suspected "weapon". Even then, they are Supposed to be trained to shout "drop it" and wait Unless actually fired upon.

The entire state of AZ should be marching in the streets demanding murder charges and firings of a dozen murdering cops and anyone associated with this act of terrorism. Storming anyones home is an outrageous and illegal practice and the only justification for it would be a matter of life or death situation.I could care less whether the house was filled with drugs,money or whatever.Looks to me like gangsters are trying to arrest gangsters.I can't tell the difference.

To Kathy Johnson: The dead Marine did not have an automatic rifle: "With automatic rifles if you pull the trigger it will fire rapidly". The dead Marine had a semi-automatic rifle that of course requires a squeeze per shot to fire. Perhaps you should take some of your own advice and learn the facts before commenting, as you obviously know nothing about firearms.

Somethings are missing here. 1. There was a long, prior investigation, so that must have given them "probable cause" 2. Point a gun at a cop, go down, plain and simple! I believe that in AZ there is a law that if someone is pointing a gun at you or someone else, you have the right to shoot them. There is more details to it but you get the point. Dont point a gun at someone and expect to live! If some suspected criminal pointed a gun at you, your kid or your mom, or dad would you shoot them or say wait, let me explain.............. You think just because there is no criminal record that doesnt mean he isnt a criminal, and just because he had a wife and kid(s) doesn't mean he wasn't a criminal either. They will release information when the time comes, do you think just because we dont have the details means there wasnt any evidence? Geeze oh petes.

I have two trains of thought.

The 'ideal' outcome of this incident is the one hoped for. The one we, as Americans, hope and pray and base our everyday existence on - that of "Truth, Justice, and the American Way". The one where the 'Peacekeeping Authority' involved exhibits complete honesty through total transparency, examines ALL the facts PUBLICLY, holds any and all persons accountable for their individual actions if impropriety is discovered, and POLICY reviewed and modified when found to be inadequate to fulfill the duties required in the manner stipulated above. This would be exhibited if and when either PCSD and it's Sheriff, or the Attorney General's Office of Arizona were to fully investigate this incident, and release THE FULL APOLOGY FOR JOSE'S UNNECESSARY DEATH, and the (more than one according to the SWAT Team Leader's statement) Officers that stated they were 'fired upon' step forward and admit their error THAT CAUSED JOSE'S DEATH, and be held accountable. Depending on the 'search warrant' and whether it meets the 4th Amendment requirements - accountability goes ALL THE WAY UP THE CHAIN OF COMMAND - action may be required there also.

It's the other train that worries me.

The one where the Indiana State Supreme Court gutted the 4th Amendment stating that a 'proper' search warrant wasn't necessary (!) The one where TPTB stands by the actions of their enFORCErs. The one that says "because of XYZ, Jose Guerena's death was justified." The one that releases the helmetcam video of the guy in the back instead of THE LEAD that actually showed what happened.

The one that sends the most disturbing message ever received by 'We, The People' from those who we have 'invested authority' onto. The one I have not written in print for the public record so as to not be marked any more of a 'Domestic Terrorist' or 'violent threat' than I already am (because I carry a Constitution, believe and uphold it's basic tenets, dare to arm myself to protect my Life, Liberty, and Property, campaign for Ron Paul, and actually have - OMG - BUMPER STICKERS!!!)

Am I the only one to see clearly that GOVERNMENT has instilled a NO-WIN policy here that results in not only the death of those they were created to protect, but the possible and (from what I can see) UNAVOIDABLE unnecessary future deaths of order-following officers sent to houses like Bill's?

In these days of criminals masquerading as police to do home invasions, if, by the time you have assessed the threat and stand down for the real police only to be shot as the threat, then standing down no longer becomes an option. RARE is the OathKeeper, Veteran, or Law Enforcer who decides that DISARMAMENT is an option at all - so I don't even consider it as an alternative.

Bill Buppert identified the message that will be sent most clearly if PCSD 'investigates itself, and finds no wrongdoing', and the State of Arizona doesn't step in and act - "They are declaring WAR on Americans."

I'm a marine vet and in vietnam we just didn't walk throw a village shooting the hell out of everybody everytime a branch snapped. If he was under investigation then they obiviously would have known he worked at the mine and good have arrested him there and drove to his house and used his key to get in. But noooooo. These mutts just wanted to play cowboy and kill. Shameful cowards, all of them.

Happens every day of the week in U.S.A. More reporters should have the fortitude and guts to report on an out-of-control police state; especially since 9/11 and the Patriot Act. I don't want to make claims of blood lust or prejudice but it is compelling when one views the physical actions of these officers. Clearly there was a failure of intelligence on their part.. perhaps even a failure to consider the need for intelligence when committing to an armed action such as this. Watching officers circle and rush to fire blindly through an open door shows an amateurishness one would not expect from what is supposed to be a highly trained squad. And then the indecision on how to secure the house both inside and out dragging on as long as it actually did... There is no doubt that this was manslaughter. There is enough on video to suggest murder though hard to convict. It is fortunate that their absurd spraying of lead did not kill the wife and child. From the audio it is clear they had no visual yet statements are made to the contrary after the fact. To me, there is no doubt as to why the investigation is sealed. The action was botched from its inception... that is, from before they ever reached the home. As for attacking Salem-News for making comparisons regarding the call for medical assists, such comparisons are absolutely legit as they raise questions about the intent and actions of what is either a keystone cop enterprise or a death squad. Opening the investigation would certainly help to clear this up one way or the other. To the writer who questioned my earlier comment about the mouse trap/grenade, no it was not intended to somehow justify the actions of SWAT.

Sheriff Dupnik murdered an honorably discharged marine, who served 2 tours in Iraq, 6 years in the marines, worked a graveyard shift, 12 hours at a mine, raised 2 young children. Sheriff Dupnik never served in the military. dupnik hasn't commented on the murder yet. I'm not sure, but I think Dupnik set a Guiness Book of Records first place for most bullets fired at a single suspect, also in the shortest time. Someone should give Dupnik a trophy.

@cop Wow, did you watch the video, and what fantasy land are you living in? Fact is his weapon was on safe and the Swat team unloaded anyway with no verbal warning warnings or anything. 70 rounds? Yea and thats not exessive? May I remind you an hour later the paramedics were called and let in to treat him? Obviously you know nothing about law enforcement at the slightest. You remove the suspect IMMEDIATELY from the scene after you clear the house of all others, which in reality take 2 minuets max. Fact is I AM A U.S. Marine and have alot of Friends in PHXPD Swat and they said the same thing I'm gonna say " They just F**KED our whole community" 2nd Going off a freaking bobble head? About 90 percent of this article is wrong. Information wasn't initially released because the investigation was on going. Cops knocked and announced with sirens blaring.
You corrupt and immoral reporters never reported that numerous neighbors (which spoke incessantly about the incident) all supported that the cops APPROACHED with lights and sirens, remained in the driveway with lights and sirens and knocked and announced and waited before entering the home. However, a proper search warrant service doesn't make headlines.

Police don't have any policy (not would it be safe) to wait until you're shot to return fire. Therefore, a man pointing an AR15 shouting "I've got something for you", which was always reported, would be reason to shoot someone dead.

Even though nothing illegal in and of itself (contraband) was found, it doesn't mean items weren't found that links him and his family to criminal activity (such as large amounts of cash, Border Patrol uniforms, ballistic vests, guns, pictures of the patron saint of drug dealers, Jesus Malverde, etc)....

I'll tell you what needs federal intervention is shoddy reporting sites like this one that jump to conclusions. Media wants information a second and a half after it happens and if it's not given, it's a "cover up." If initial reports turn out to be incorrect (such as the shrapnel hitting the shield at several hundred miles an hour and the officer thinking it might be bullets), and that's what initially is given by media relations officers, then it's a conspiracy. Come on...you can't have it both ways.

Just about every cop I know is far more conservative, far more small government minded than the average person.

I do not understand the quick judgements without sufficient evidence. It is clear most are just trying to advance their own agendas. The hatred of police is also sickening. This is a horrible occurance either way, and we will never know the whole story. I am sure the police had no intention of "murdering" a combat vet though. They act on intel, just as soldiers do. Many of them are probably vets as well. I just think you should not be so quick to judge anyone who puts their life on the life for the public, soldier or police officer.

Tim King's story is full of half truths, assumptions and exaggerations. The police have just released the video of the swat teams arrival and it clearly shows they arrived with sirens and banged on the door and announced police in english and spanish and then had to break the door down and looked in and saw him aiming an automatic rifle at them and they fired. With automatic rifles if you pull the trigger it will fire rapidly. Too many people commenting here on something they are clueless about.

Tim King: I don't think too many people are clueless about super careless police work.I don't think they they are necessarily unaware of the pain that a murder causes. That's right, a murder. The officials changed their story, they failed to do their research, complain all you want about my story, people are provided links to local media, they can go on from here and keep learning, I suspect they won't walk away thinking anything the agency did on this was right. Of course it doesn't matter how severe things like this are to some; if the people wear a badge that somehow makes it OK, and I call that denial.

A terrible injustice has been served to Jose Guereña by the Pima County Sheriffs Department, the so called justice system and Mr. King. The Pima County Sherriff Department for his brutal murder, the justice system for assisting in covering it up, and Mr. King for using Jose Guereña’s death to advance the liberal agenda. This story was not about Jose Guereña; there is no mention of his rank or other accomplishments in the service of this Nation. None of that was important enough to be reported. I am on your side when it comes to the issues in Palestine, etc. My comment was more relating to the substance of this, unrelated, article and the comments that people were making that indicated a concern that you were trying to link the actions of the police directly to the treatment of the Palestinians. These are not related. As a newscaster, I know you can see why there was a concern that you linked them together. If you want to draw broad strokes about events, I am sure you could toss in a reference to Palestine (or for that matter, draw links to other events in the world) with mostly every article. From a PURELY news perspective, this killing is in no way associated or affiliated with the Zionist-Israeli treatment of the Palestinians.

Tim, I have to agree that, as a news story, any comment that does not address the actual event is propaganda. Referencing Palestine, etc., makes the news story something different from pure news. I am not sure what it is called, but I can see where people are trying to share their concern. All you need to do is indicate that you are providing associated commentary along with the news, however, rather than insult them.

Tim King: We write and report about Palestine every day and one of the most frustrating, terrible and regrettable things we publish, is the fact that the Israeli ambulance drivers are prevented from accessing patients, sort of like after the US Apache helicopter attack on the journalists in Iraq that Manning helped bring forward. In that event the US Army refused to transport two horribly injured children.. This is Israel, funded by the US taxpayer, and operating with free will. All these John Wayne, barrel chested, blood thirsty, trigger happy, poorly trained, ill equipped, uneducated punks with a badge should stick to beating their wives and drinking Busch beer while watching Cops. I appreciate and deal with goodhearted police officers and they are out there. They are very few though. I pray for Jose's family and I thank him for his service to his country. Hats off to a man trying to defend his loved ones.

For you to gratuitously drag Israel into it, and falsely, too, when the situations are vastly different,shows a sickening bias on your part - if not merely shocking ignorance. You are PROSTITUTING this tragedy for your own vicious ends and should be ashamed.

Editor: No Susan, making a reference to Israel is perfectly logical; how dare you accuse us of that when war crimes are being committed? Did you think that you had an exception? If I accused you of jaywalking you would yell 'antisemitism'. You should be ashamed of yourself.

I don't know much about Dupnick but I would question his ability to command as well as his personal ethics. How could you allow this story switching, sealing of warrants, and 60 hits to a suspect without opening an investigation within your own department. How could he not appeal for a higher-level investigation to be done by an outside agency. It won't bring her husband back but I hope Mrs. Guereña sues the county, dupnick, and every officer who participated in that bogus raid. I would be disappointed if she left Dupnick with enough money to buy a roll of toilet paper. He and his crew of morons give law enforcement a black-eye and the rest of us nausea.

This article makes me sick to my stomach!! The police have all the rules on their side. We citizens need someone to protect us from the police. Arizona has continued to spit in the face of human rights and justice as stated: "Pima County Sheriff Clarence Dupnik infamously stated last January, that Arizona is a "Mecca for prejudice and bigotry." Don't we have a federal government that can help the Arizona people protect themself from this out of control law enforcement that would shoot down a family man in his family home. And maybe they need to budget some bullets, leave some of the SWAT TEAM at home, save some money by only killing a person once, not riddle them in front of their family! Who's worse the Arizona law enforcement or the Cartel? I will pray for Marine combat veteran Jose Guereña 's family and comrades justice. Thank You for bringing this story forward.

I feel for Guerena and his family. This should never have happened, and I hope that the cops who participated in this travesty are punished appropriately.
However, I can do without the gratuitous antisemitism.

EDITOR: We can't change the facts. The statement about Palestine lives is true, and valid. Though I do apologize that you are uncomfortable with that, we all are. There was no antisemitism anywhere in this article, for the record.

This disgusts me. I am tired of hearing about the way the police cover up their actions with whatever story they think will gain traction. This sort of cover up happens in Salem all the time. The good police seem to be outnumbered and afraid of speaking up. So much for the Constitution.

71 shots fired at a man who fired not one. OK.. so I put a grenade on this mouse trap and when he went for the cheese, the trap closed on him and squished his head. At the same time, it pulled the pin on the grenade and blew his ass through the wall and down the street. Overkill? Speedy Gonzales will never bother me again! What did I tell the wife when she saw the hole in the wall? "Shut up! I did what I had to. He didn't belong here"
