Obamacare Victory Approaches

Every media outlet, both right and left, everywhere in between, has gotten suckered on this.

From the image 'Obama's Pill: Republicans got the argument completely wrong' - Obamacare was not "rammed down our throats." This was a suppository! Politifake.org

(SANTA MONICA) - "Obamacare's Supreme Court Disaster" screams the headline at Mother Jones. The Chicago Sun Times reports that the "President embraces term Obamacare." Search for Obamacare on Google and a paid advertisement for Obama's reelection website sits at the top of the page.

With another election coming up the end game of the main legislative push of the administration's first term is coming to its conclusion.

As should be expected from the team that ran the slickest marketing campaign during the first election their ability to run the media and control the message on their legislation has been second to none.

While the political press is busy chasing their tail barking about "disaster" a well choreographed political performance is inching toward inevtiable victory.

I recall reading and analyzing about a thousand pages of the "Obama" (a.k.a. congress for people who are interested in accuracy) health care plan.

In fairness to the rest of the media, and the politicians, and CEOs, I can't really blame them for getting the story wrong. They never bothered to read the law that was actually being passed.

What the current story on the Supreme Court arguments is missing - that one crucial element - is that what is being challenged in the Supreme Court this week is a couple of paragraphs out of a thousand pages of legislation.

A couple of paragraphs get crossed out. A thousand pages still stand.

What are the contents of those paragraphs?

A government mandate that all citizens must buy health insurance from private for-profit corporations or face fines levied in the form of tax penalties.

Crazy! Obviously unconstitutional. Totally objectionable to everyone left, right, center, and martian.

So, why was that requirement in there? Because it offered the insurance companies the promise of increased revenue in exchange for the requirements that they treat their customers fairly and stop using a bunch of lame gimmicks to rip them off.

That promise brought them on board or at least far enough on board that they were willing to let the legislation pass.

Now, the hard truth of the matter is about to bite them in the ass. The legislative process does not stop with Congress.

The Supreme Court can strike down any law they choose, but only if it is "uncostitutional."

The Supreme Court can strike down the health insurance mandate, but everything else stands.

All of the parts of the law that benefit consumers will still stand. The one part of the law that was a blatant giveaway to the insurance industry will be struck down.

Who wins?

It might take a while to sink in but this was a rigged game from the start.

It was obvious that this legislation would end up being reviewed by the Supreme Court. It was obvious that a health care mandate would be found unconstitutional.

To understand this you have to understand that what is unconstitutional about the health care mandate is that it undermines the power of the Supreme Court itself.

What the Justices asked in their hearing was, if the government can arbitrarily require people to buy something, what can they NOT do? The answer is nothing. It is a blank check for Congressional excess, not just over the citizens, but over the Supreme Court.

Even in a corrupt political process the one maxim that can always be relied upon is that no one will ever consciously undermine their own power or position.

All of the bribes in the world couldn't make those fat, well paid, and life time appointed Justices sell out their own court and their own power.

The conclusion was written before the game even began.

The striking thing about this story is how easily the Obama team was able to turn the opposition into their mouthpiece.

Every media outlet, both right and left, everywhere in between, has gotten suckered on this.

But the people on the right, the people who turned "Obamacare" into a slogan, they got suckered the hardest.

When the Supreme Court delivers their opinion in the middle of the presidential campaign, then you will hear a detailed explenation from the candidate of how "Obamacare" was a resounding success.

All theatre. But very well staged.

Ersun, you bring up many good points, your real level of success with articles you have published here is excellent, your choices in material address things in a way that I like, and you strike me as a common sense writer without ridiculous alliances, it means a lot. Republicans and Obama have a lot in common, and my guess considering your past articles, is that you nailed it again..
