Memorandum on the lies and misleading statements of the Sri Lanka high commissioners and government

Sri Lanka claimed to have established the lesson learnt and reconciliation commission on May 2010, but there is no evidence of any such initiatives towards restorative justice in the war affected areas.

(CHENNAI) - The Sri Lankan government has vehemently denied any civilians were ever killed during its final offensive against the Tigers. The Government has claimed that it has embarked upon several initiatives in the areas of resettlement, rehabilitation, economic development, reconstruction and reconciliation to benefit those whose lives were affected by 30 years of conflict. In addition it claims considerable action has been taken by the government to facilitate the restoration of normalcy in the lives of the returning IDPs (internally displaced persons).

To support the returnees to their original areas of habitation, a large number of houses have been constructed in the former theatre of conflict and distributed among the resettling IDP families. With regard to rehabilitation, former child combatants have been rehabilitated and have been beneficiaries of educational programs including vocational training.

A working visit of three Malaysian MPs Datuk Johari Abdul (Sungai Petani), Suadara Manoharan (Teluk Intan) and Senator S.Ramakrishnan with 2 other activist from the 1st June to 6th June 2011, has found that about 300000 innocent civilian victims mostly women and children, of the war are still held in IDP camps, the LTTE cadres including suspected youths both male and female are held in detention camps. Many family members do not know the whereabouts of these youths including whether these youths are actually alive or not. Women head most households in the affected areas and nearly one third of households in the Kilinochi (North East of island) area alone are run by women. As single parents, widows or those whose male family members in detention are vulnerable to several social conditions, disadvantages and atrocities. The areas of concern are broken family institutions, lack of schooling, livelihood, prostitution and sexual exploitation, resettlement, youth development and security. There are no toilets and privacy at all for the women in the IDP camps. The army has robbed of all the belongings of these residents in northern and north eastern provinces. Their houses are flattened during the war. These provinces remain militarized and no outsiders are allowed to visit without the ministry of defense approval.

The war is over but the conflict remains unsolved. The grounds that ignited the civil war remains unaddressed and victims left unattended and victimized by their very own government. The government is still on triumphant mood and adopting a winner takes all approach. There is no civil law in north and north eastern province. The army personals in north and north east are the kings who lord, loot and terrorize the people who have nothing left but want to rebuild their lives. The huge presence of military is a hindrance and delays the return to normalcy. All the talk of rehabilitation, reconstruction and reconciliation are not translated into action yet. The proposal to construct houses by India is deliberately delayed by the Sri Lankan government. The government of Sri Lanka is not serious of return to normalcy in northern and north eastern province. The international community is being misled by all the rhetoric on promises of efforts to rebuild, rehabilitate, reconstruct and reconciliation in the war affect north and north east provinces by the Sri Lankan government. The residents of north and north east provinces have lost all their basic human rights to the army and looking to the international community to help and to voice out for them.

In view of above facts we the Malaysian members of parliament condemn the actions of the Sri Lanka government and the military in particular for not engaging in true, sincere and serious efforts towards reconstruction, reconciliation and rebuilding the affected areas and the people therein. Instead of nation building the Sri Lanka government’s very actions seems to be reflecting the root causes of the war itself. There are evidently proof of human rights violations and crimes against humanity for which Sri Lankan government must be held accountable and responsible.

French politician and statesman Henri Queuille once described politics as the art of postponing decisions until 'they are no longer relevant'.

But this, well known saying, has no sense as far as the Sri Lank genocide of Tamils, is concerned.. What happened is the most creul war-crime by a state terrorism aganist unarmed and innocent civilians in recent human history.Congressman James McGovern, co-chair of a US Congress human rights commission described the Channel-4 documentary, Sri Lanka's Killing Fields, as "a gruesome example of humans at their worst,"(AFP Report). If these crimals weren't brought to the justice then the international laws and institutions (UN, ICC, HRW, ACF, UNHRC, UNHCR, AI, and Red Cross) all loss their meanings.

This is great news for Tamils and the right-minded people around the world and that already billions of people are behind the war crimes prosecution demand. They need the long arm of the justice at work now.

“How the West wanted Sri Lanka's terrorism tackled is a case in point. If this country had adhered to their roadmap for a 'negotiated settlement' and continued to appease the LTTE, it would have faced the same fate as Sudan. Perhaps, it would have been cut in half like a melon much earlier. Most of the foreign powers involved in Sri Lanka's peace process which was heavily weighted in favour of the LTTE were instrumental in creating the world's newest state, South Sudan”.
We need the direct UN intervention (if necessary armed intervention) to remove the occupying Sinhalese army from the north and east and recognise Tamil Eelam as a member of the UN and the international community. If there is going to be opposition from the Sinhalese regime to such an intervention, force will have to be used ( Libya, Balkans, East Timur ).
The war criminals have to be arrested and herded to Hague to be prosecuted. A special tribunal along the lines of Nuremberg Tribunal has to be set up for this task. No one, from India or Sri Lanka, should be spared if they are guilty.

It was surprising that the Rajapakse regime managed to get the United Nations HumanRights Council to pass a deeply flawed resolution on 27 May 2009, on Sri Lanka that ignored calls for an international investigation into alleged abuses and India, being a partner in the genocide had to support the resolution. This resolution was just a nasty political act and never an epitaph for the defenceless men, women and children who died in the war. What happend in Mulivaikal as shown in CH4 video programme is only a very small part of very long cruelty of Sri Lanka state terrorism aganist innocent Tamil civilians since 1948.

At the end of May, just a fortnight after the human massacre, the U.N. Human Rights Council held a special session on the human-rights situation in Sri Lanka. UN High commissioner for human rights Navi Pillay called for an independent international investigation into violations of international human rights and humanitarian law. She said, "The images of terrified and emaciated (thin and feeble) women, men, and children fleeing the battle zone ought to be etched in our collective memory. They must spur us into action."

Yes madam, that is what is exactly happening. We Tamils salute Ch 4 and the magnificiant men and gadgets.

Richard Dixon wrote on 12th june 2009, "Knowingly or unknowingly, we have all been witnessing one of the darkest chapters in humanity, now being written by the blood of innocent civilians in a land that was once known as Pearl of the Indian Ocean. The ugliest part of this chapter is not what is happening to the innocents but the response from the civilised world that has so far failed miserably to save the lives, although it has the power to act."

Our dear Richard Dixon, it is not the power or lack of power, the problem, the civilized India and UK are simply partners in the genocide, a nasty team work. The great Indian people will take care of India, with the great news that at last North Indians have woken up to the call from Tamil Nadu. Hopefully Central Government of India get into action and get the Tamils in Sri Lanka their legitimate rights, quickest way is ,to recognize Thamil Eelam before Sri Lanka colonize and Sinhalise, an agenda quietly encouraged and funded by the Imperialist forces led by the UK govt.

The difficulty is for the UK government, past, the real culprits and presant, confused one. From what Liam Fox said in Colombo and what the David Miliband said in the Headlines Today, they are trying to get the Sri Lanka government's the Lessons Learnt and Reconciliation Commission (LLRC) to examine all the evidence and make final credible recommendations to the Sri Lankan government, before November suggesting an escape route, a wishfull blunder!

The Tamil Diaspora, except the BTF and Keith Vaz , are wondering why this great country, where 'Democracy Matters' shouldn't shed off India and take the lead and call for an genuine international investgation, as what Pillai said; “... must spur us into action."
