Oregon Medical Marijuana Users Arrested for Lack of Compliance

Medical marijuana use is legal for registered patients in Oregon, but police say the people in this case were out of compliance with state law.

(SALEM, Ore.) - The Salem Police Street Crimes Unit arrested three people Monday for possessing and delivering large amounts of marijuana. They also took three minor children into protective custody after the search of two different residences related to the case.

Salem Police Lt. Jim Anglemier says that around 6:30 PM Monday, detectives from his agency and Polk County arrested Sharon Marie Biggar and Michelle Lynn Marchand who had delivered one pound of marijuana with an estimated street valued of $4200. The investigation continued with a search of Biggar & Marchand's residence, located at 6880 Corvallis Rd., Independence, OR.

At Biggar and Marchand's residence, Anglemier says they found another two pounds of marijuana, valued at $8400, 23 grams of Hashish and three firearms.

"At the time the residence was searched, there were three small children present who reside there. The ages of the children were 3, 12 and 14 years." Anglemier says the children were taken into protective custody.

Michell Marchand is a medical marijuana provider who police say was out of compliance. There are laws that allow Oregon Medical Marijuana patients to possess substantial amounts of marijuana, but there is no sale of marijuana sanctioned by Oregon law.

The investigation led to a second residence located at 261 Eola Dr. NW, Salem, OR., where David James Edgar resides. David Edgar is also a medical marijuana provider.

From the search of that residence, over seven pounds of dried marijuana with an estimated street valued of $28,000, along with 36 mature marijuana plants, some six feet tall according to Anglemier, and 100 immature marijuana plants were seized, with street valued estimated at $302,400. "Additional evidence to include scales, packaging materials, and drug records were seized," Anglemier added.

All three adults arrested were booked into the Marion County Jail. 39-year old Sharon Marie Biggar of Independence is charged with Unlawful Delivery of Marijuana, Unlawful Possession of Marijuana, Unlawful Manufacture of Hashish, Unlawful Possession of Hashish, 3 counts of Felon in Possession of Firearm, Maintaining a place where drugs are used, 3 counts of first-degree Child Neglect and 3 counts of Endangering the Welfare of a Minor. Biggar's total bail is $155,000.

33-year old Michelle Lynn Marchand of Independence is charged with Unlawful Delivery of Marijuana, Unlawful Possession of Marijuana, Unlawful Manufacture of Hashish, Unlawful Possession of Hashish, 3 counts of Endangering the Welfare of a Minor and Maintaining a place where drugs are used. Marchand's total bail is $140,000.

27-year old David James Edgar of Salem faces charges of Unlawful Delivery of Marijuana, Unlawful Possession of Marijuana, and Unlawful Manufacture (Growing) of Marijuana. Edgar's total bail: $70,000.
