Does Obama Have Control of the DEA?

Has the time arrived for Obama to take his gloves off and overhaul the DEA from top to bottom, or is it even an option?

(SALEM, Ore.) - The DEA is defying President Barack Obama's word that the Department of Justice would no longer be used to harrass and arrest owners and operators of medical marijuana dispensaries.

does not support raids on cannabis
dispensaries in states where laws
have been passed making it legal.

"I would not have the Justice Department prosecuting and raiding medical marijuana dispensaries; it is not a good use of our resources," then Presidential Contender Obama said, on August 21st 2007.

The group Americans for Safe Access reports that on Thursday, the Drug Enforcement Administration, still mostly comprised of officials from the Bush Administration, raided a medical cannabis dispensary in South Lake Tahoe, California.

"They did so knowing full well that President Obama has repeatedly pledged to end federal threats, arrests, and prosecutions of patients and their providers in medical cannabis states," the ASA's George Pappas said.

Obama has stated on more than one occasion that he is not interested in locking up non-violent drug offenders as felons which leads to no good prospects except drug dealing and other criminal activity. Obama said in September 2007, that he believes when it comes to offenders, "they become more locked into crime from being in prison."

We have included video below of President Obama making the quoted statement above, and more. Why is the DEA so intent on carrying on what many call "thuggish behavior"? I find it interesting, especially when considering recent statements made by Courtney Love about a Hollywood actor/alleged illegal drug supplier who she claims led Kurt Cobain to his death and also nearly led actor Owen Wilson to his.

In August 2007, Socialite Life and other sources including the NY Times, reported accusations from Courtney Love over a supply of drugs coming from an actor she once dated, Steve Coogan.

Courtney Love blames this British comedic actor, her ex-boyfriend, for leading buth Kurt Cobain and Owen Wilson down a path of drugs and self-destruction.

One almost has to wonder if Coogan has been hanging around with Joaquin Phoenix lately; it would possibly explain his recent, bizarre behavior. (see my article: Joaquin Phoenix Takes a Dive; Career and All)

Love may know a thing or two about Coogan, it was reported in August 2005 that Love was furious with herself for allowing Coogan to talk her into having unprotected sex.

Prior to the affair with Love, Coogan had married a woman named Caroline Hickman, who divorced him on the grounds of unreasonable behavior. Then a 39-year old father of one, Coogan had married Hickman in December 2002. They had just got back together after splitting up over a fling he had with a lap dancer, metro.co.uk reported. Apparently the habitual drug use that Love ties to Coogan became so bleak for Owen Wilson, celebslam.buzznet.com reported, that his pal Woody Harrelson even tried to stage an intervention at his home in Maui.

"I went through it with Steve. I was just out of rehab, and he was right there with the drugs. I tried to warn Owen. I tried to warn his friends. I hope from the bottom of my heart that Owen stays the hell away from that guy." (see: xanga.com article: Owen Wilson was a junkie)

Wikipedia reports that Steve Coogan responded through Access Hollywood, denying Love's accusations and offering support to Wilson. "My thoughts are with my friend Owen at this difficult time, but I do want to set the record straight and say that the allegations...are completely and utterly false," he said. Of course some will find irony in Harrelson, well-known for his marijuana use and advocacy, being the one trying to save a friend who is on drugs. Until the "Reefer Madness" paranoia of the 1930's, marijuana had always been a top remedy among doctors for helping drug addicts kick their habits. The DEA today considers it to be in a class roughly with heroin.

Regardless of their record, it is still confounding that the DEA would act so quickly to undermine and disregard the statements made by President Obama about legal medical cannabis, while allowing the rich movie star set's hard drug dealers to roam free.

I can appreciate that these are only allegations from Love, and Coogan may be guilty of nothing at all, but I would feel better personally if there was at least some reference somewhere to an investigation.

The raid in California is simply another response from the pharmaceutical companies that exercise control over groups like the DEA. They dread seeing medical marijuana advance and as a natural effective medicine, they know its increasing legality threatens to potentially devastate their treasured "bottom line", says Medical Marijuana Expert Dr. Phillip Leveque who also writes for Salem-News.com.

Situations and attitudes change and progress in this world, and the Drug Enforcement Agency, still insistent on raiding legal cannabis dispensaries, needs to swallow that bitter pill of understanding.

ASA bemoans the fact that this latest raid took place, "We are shocked and awed! For DEA to act with such brazen arrogance and in direct conflict with the new President’s pledge to end federal raids is deeply concerning. With only weeks left in office, it is clear that top DEA officials are using this transitional period to exploit the differences in policy between the old and new administration."

It seems hard to believe that high level people from the entertainment world can expose drug dealers on the Internet and in major newspapers and nothing happens, but places where sick people get their medicine are regarded as lawless organzations by the DEA, even though voters in California specifically elected to make it legal.

Cheryl Aichele, a vocal medical cannabis activist in Los Angeles, says "I don't like it when the DEA comes in fully armed into our beautiful state with their paramilitary-style raids on medical cannabis patients and providers. I'm angry that they raid with masks, helmets, shields, and automatic weapons forcing injured people to the ground with the DEA's feet on patient's backs and DEA guns to patient's heads."

She says it is disappointing to see a federal agency waste so much time, energy, and resources to ruin the lives of Americans when the cannabis itself could do no comparable damage.

"I feel sad that they don't seem to care about the sick and injured, like me. I feel hurt because I have seen first-hand the kind of damage the federal government can cause in the lives of honest people. I feel worried when I hear about them raiding yet another medical cannabis location. I feel scared because if they are successful, I will be forced to buy my medical cannabis on the "black market" from real criminals instead of safely accessing medical cannabis from compassionate providers."

Aichele concluded by saying she is embarrassed that our government has taken this war on cannabis this far.

"I'm sorry that Obama hasn't already told the DEA to leave us alone. I feel ashamed because my own tax money is going to their actions. I don't want good people to suffer because of bad laws."

Cannabis advocates say it's time for Obama to take his gloves off and overhaul the DEA from top to bottom. It is true that we need maximum integrity from federal cops and they have to work in sync with the will of the American people in order to be most efficient.

Don't think for a second that the DEA is defying Obama. The Obama administration has said that they will not raid medical marijuana dispensaries that are in compliance with state law. Attorney Bruce Margolin who literally wrote the book on medical marijuana law said in his book that an examination of California medical marijuana law reveals that ALL dispensaries are operating outside of California law. The case law reveals that the only places that are within California law are co-ops and collectives, definitely NOT dispensaries. Even though local and county governments give permits to dispensaries, they ARE operating outside of the broader controlling state law because they make money. California law clearly states that there is to be no money made from medical marijuana laws, period. The only money that can be involved is money that is used to reimburse people who run collectives or co-ops. Some dispensaries in California are making more than $500,000-a million a week above "expenses". So, the Obama administration, which is in charge of the DEA, is doing what it said it would, not raid places that are in compliance with state law. All of the dispensaries that the Obama administration has raided were operating outside of state law.

I don't feel like we should use the word "marijuana" anymore. This was an invention by those who fought and lied so hard to instill fear in those who would likely misperceive the reality of the situation by giving cannabis a mexican sounding name that correlated with their racist stories. If the big corps and scandalous government of the old times can make up new names for things to spin their true meaning, then maybe we should too. As long as we refer to Cannabis as "marijuana", we will continue to spread the fear, paranoia, and hatred of an equally beloved species. So, whose with me. Let's reinvent the steel, so to speak. Every single public poll supports safe access to medical cannabis by a wide majority. DEA raids on medical cannabis dispensaries target the ill and disabled; are mean spirited; and do nothing to reduce illicit drug use. The public speaks, but politicians don't listen. But now I have a solution. Ever since I heard about the January raids I have been answering all fund raising phone calls and mail that I get from the Democratic Party with this response: "I will not give another cent to the Democratic Party until they support a complete overhaul of our Federal drug policy; stop the Federal persecution of medical cannabis users, providers and caregivers; and remove Cannabis from it present Schedule I classification." When I speak with fundraisers on the phone, I am always polite, but I tell them in no uncertain terms what my position is, and that I will no longer be donating until the party's policies change, and I ask them to please give this feedback to their supervisors. Money talks volumes, and it seems to be a language politicians understand. I am putting that unfortunate reality to work, and hope others do the same.

even though I wish ohboy was a bit more diplomatic, there are points to be considered. Obama DID talk about supporting many social services in March 2008, and I disagreed because I knew come Jan 2009, that he would say he cant. And it happened just as I said. And, he supported the bailout Sept 2008 that did nothing but put money in the banks who wont lend. So, yes, Obama has blame. But, you are not getting the point. This is NOT a right/left issue. The right/left issue is a distraction. The true people running this country are loving this. People fighting left/right, while they get their way. History proves this. It is not about left or right, it is about truth. Which the mainstream is not telling, neither is obama, not mccain, not most of congress. The Obama Recession Worsens: Caterpillar Cuts Thousands of Jobs
The Obama recession is getting worse, as tens of thousands of blue collar jobs have been cut at major companies since Jan. 20, the day Barack Obama was inaugurated as president.
Caterpillar Inc said on Monday that quarterly earnings fell more than 32 percent and warned of a tough year ahead as the downturn that began in the United States metastasized into a full-blown global recession that hit sales of its earth-moving equipment.
The company also warned that profit in 2009 would be under severe pressure and said that it would cut about 17,000 workers and buy out 2,500 others, to reduce costs in the face of what it predicted would be the weakest year for business since the end of World War Two.
The news sent the company’s shares skidding more than 10 percent in premarket trading.
Hope and change has not worked — companies are still cutting jobs. Obama is to blame. We need congress to begin impeachment proceedings and remove him before it's too late to recover. Many scholars, authors, and learned people disagree with you. YOU, yourself can disagree, and that is ok, but, to make a blanket statement such as this one is not appropriate in my opinion. On another note: I did seem to get off the main subject tho, my apologies. I am an advocate of legalizing marijuana. I dont partake now, I have a family and cannot take the chance of hurting them through an arrest. But, through my studies, in regards to how it became illegal, and the medical benefits, it is obvious to me that marijuana should be legal. What is even more interesting, is that "hemp" which is not a drug, is illegal. Something for the "truthseekers" (that another poster here wants to get rid of, yeesh) can research. I liked your post Doc, but I would suggest you not use the truth seeker words. Unless you explain what that means.

So, a presidential candidate can make an opinion statment without stating what the current Federal laws are. Now that Obama is president, doesn't mean his opinion from over a year ago has become law. Federally, marijuana is a Schedule I, the THC is synthesized and available in a prescribed form of medicaion. Just because a state makes it's use leagal, that state cannot override a Federal law. So, with that said, DEA does not create or make the laws (nor the FBI, ATF, IRS, et al). The DEA has full authority to enforce all violations of Title 21, "The Controlled Substance Act of 1970" and will continue doing so until that time when the laws are changed. With that said, one man's opinion (or several it seems) does change the law.

I humbly disagree Henry. I think people are feeling let down because they are seeing the truth. His cabinet members, closing gitmo when he already knew it would just go to the U.S. puppet in Iraq. Still spending, and still blind support for Israel. Now bombing pakistan. It just never ends, and seriously, keep an eye open. You will see no change in agenda, because obama does not run the agenda. He is but another puppet of the NWO. Sure, I'll be patient, but please let me know when he does something different than bush, clinton, and several presidents before him. The prohibition of Cannabis is corrupt from the start. Little wonder turning our law enforcement agents into vandals and thieves is the primary effect of the corrupt law. DEA Judge Young determined that Schedule I was inappropriate for Cannabis twenty years ago. The Shafer Commission said to legalize it in 1972. Cannabis was included in the United States Pharmacopoeia for most of a century. FDA, please describe the rigorous science that led to its removal from Edition XII? (IIRC, it was something about "white men's shadows"...)

It would seem to me that the separation of powers would give Obama very limited discretion in what the DEA does, how it does it, and what laws it enforces. Seems to me that you have to change the law, not just make the agency look the other way. Or, is that the new "law"? Just do whatever you want? Pot's no magic or sacred plant. It offers little or no benefits that can't be obtained better by better living or better choices. Seriously, of all the really truly important stuff... legalizing pot or even discussing it should be right below "invade Canada".

65-70% support national voter support for decrim and 75-80% for medical marijuana. The time is now. Look at what is going on in parochial Puritan MA, the voters have spoken and most of the cities and towns are honoring their wish. And society carries on better for it. The time is now President Obama. You have the popularity, this issue does as well. Getting something done will ensure you keep it. Just use the bullypulpit with say medical user Montel Williams and the rest will truly be history.

Thanks for the article Tim. I have decided to try and hold back my opinions for awhile, no promises tho :-) because "time" is the best truth teller. We will let time tell. I am already finding in the blogs, that many strong supporters of obama are discouraged and feel let down. Just a short opinion, dont expect changes.
